1. Scope of Application
These General Terms and Conditions apply to all contracts concluded via the online shop www.bloodysweet.ch or in the physical stores of Swiss Delikatessen GmbH. They apply to all orders from private and business customers worldwide, unless more specific national provisions apply.

By using our services, you agree to be bound by these GTC.

3. Subject of Contract & Offer
Swiss Delikatessen GmbH offers food, pâtisserie, beverages, delicacies, and accessories via online shop and in-store sales. Illustrations and information in the online shop are for description purposes and are non-binding.

A purchase contract is concluded upon our written order confirmation or dispatch of the goods.


4. Prices and Shipping
All prices are listed in CHF (Swiss francs) including VAT. Shipping costs, import duties, and any customs fees for international deliveries are stated separately and are the customer’s responsibility.

We deliver to Switzerland, EU countries, and worldwide upon request.


5. Payment Methods
Accepted payment methods:
– Credit/debit cards (Visa, Mastercard, Amex)

– Prepayment
– Shopify Payments
– Cash payment in-store

Payment is due immediately upon conclusion of contract. In the event of default, we reserve the right to charge reminder fees and take legal action.


6. Delivery and Availability
Delivery times:
Switzerland: 1–3 business days
EU: approx. 3–7 business days
Worldwide: as individually agreed

If an item is unavailable, we will notify you promptly. Partial deliveries are permitted. Compensation for delayed delivery is excluded.


7. Right of Withdrawal and Returns
For food products: No right of withdrawal applies, in accordance with Art. 40c of the Swiss Code of Obligations.
For non-perishable goods: Returns are accepted within 14 days if items are unopened, undamaged, and in their original packaging. Return shipping costs are borne by the customer.

Returns and withdrawal rights are governed exclusively by Swiss law.
We currently sell and ship exclusively under Swiss jurisdiction. No foreign consumer protection rights apply.
By placing an order, you agree that Swiss law applies exclusively and that no foreign consumer protection legislation is applicable.


8. Retention of Title
Goods remain the property of Swiss Delikatessen GmbH until full payment has been received.


9. Warranty and Liability
Statutory warranty rights apply. Complaints must be submitted in writing within 48 hours of receipt.

We are not liable for indirect damages, lost profits, data loss, or consequential damages. Liability is limited to gross negligence and intent.

We accept no responsibility for delivery delays or failures due to force majeure (e.g. pandemic, customs, strikes, natural disasters).


10. Data Protection
Our separate privacy policy applies and complies with the revised Swiss Data Protection Act (revDSG), the EU GDPR, and applicable international data protection laws.

Your data will be treated confidentially, not sold, and only shared with partners required for payment processing, logistics, or support.


11. Copyright and Trademark Protection
All content, images, texts, designs, and trademarks (including Bloody Sweet, Swiss Delikatessen) are protected by copyright and trademark law. Any use or reproduction without written permission is prohibited.

Please note that we operate solely under Swiss jurisdiction. Foreign consumer protection laws do not apply.

13. Applicable Law & Jurisdiction
Swiss law exclusively applies to all contracts and legal relationships. The application of foreign consumer protection laws is expressly excluded.
Jurisdiction for any disputes is Schönenwerd (SO), Switzerland.


14. Final Provisions
If any provision of these GTC is or becomes invalid or unenforceable, the validity of the remaining provisions shall not be affected. Amendments or additions to these GTC must be in writing.
